GENERAL

by Benson AB, company registration no. 556998-6788, with address at Södra Kärr 318, 385 98 Bergkvara, Sweden, e-mail: info@bybenson.com ("by Benson"), sells design products to private individuals and companies in Sweden ("the Customer"), through the website bybenson.com (bybenson.com) ("the Website").

AGREEMENT
These general terms and conditions of purchase ("Terms") apply when a Customer enters into a contract with by Benson for any of the products provided from by Benson. In order to enter into a contract with by Benson, the Customer must be at least 18 years of age.
In order to place an order via the Website, the Customer must fill in their details on the Website. The Customer is responsible for having filled in correct account details, such as personal/organisation number and e-mail, as well as correct delivery details, such as delivery address, delivery date and time interval.
After the Customer has completed the order, by Benson will confirm the Customer's order. When by Benson finally confirms via e-mail with an order confirmation, the order has been completed and the Agreement has been concluded. ("Agreement").
by Benson encourages the Customer to save the Order Confirmation for possible contacts with by Benson's customer service. by Benson reserves the right to modify or cancel the Customer's confirmed order until the final order has been delivered.
By entering into the Agreement as set out above, the Customer accepts, and agrees to follow these Terms and Conditions. At the same time, the Customer acknowledges that they have read the information on the processing of their personal data as set out in the section on personal data below.

PURCHASE AND PAYMENT
Prices
All current prices and fees are presented in the by Benson price list on the Website, which is valid at all times. by Benson reserves the right to adjust the prices at any time. However, neither price reductions nor price increases will affect an order confirmed by by Benson. The prices on the website are presented inclusive of VAT.
For each individual order of products by Benson charges an individual delivery fee.

Payment
The payment methods offered to the Customer are those available on the Website at the time the Customer places the order. The payment terms applicable are those stated at the time of ordering, and may differ depending on the product and/or service ordered by the Customer and the payment method chosen by the Customer.
In case the Customer chooses invoice as payment method, this will be sent by by Benson via e-mail to the e-mail address provided by the Customer at the time of ordering. by Benson reserves the right to take a credit check.
by Benson does not offer any other payment methods than those listed on the Website.
In case of a refund or credit to the Client, this will be done via the payment method chosen by the Client in his order, unless otherwise agreed or it is not possible for by Benson to make a refund via that payment method.
Reminder fee and interest for delayed payment
by Benson reserves the right to charge a reminder fee and interest on arrears in accordance with the law if payment has not been received by by Benson by the due date of the invoice.

DELIVERY
Delivery takes place within 1-3 working days, provided the product is in stock.
For each individual order of products, by Benson charges an individual delivery fee. It is the weight of your order that determines the shipping cost and this is clearly stated at checkout.
Many consignments are delivered to a post office where you can then collect it using SMS notification and identification. If you don't collect your parcel from the delivery point, it will be returned to us. The same applies if you have provided the wrong address. An agent will provide the parcel for 7 days before it is returned to us.
If you do not pick up the parcel, we will charge you a fee of 195 SEK. This fee is for shipping and handling and will be deducted from your refund.
Therefore, always remember to collect your orders within 7 days of your parcel arriving at the post office.

WARRANTY
Our products are made of first-class materials and with advanced technology.
They are thoroughly tested so we can be sure they will perform flawlessly for the tasks and environments they are intended for. However, it is possible that products may have a material or manufacturing defect. It is of utmost importance for us to receive feedback on defective products as soon as possible so that we can take further action. For warranty cases, please contact the point of purchase, within 30 days of discovery. And show your receipt for the warranty to be valid.
by Benson provides a 1 year warranty on the following products:
Water hoses
Gardening tools (spade, hoe, shovel, rake, leaf rake).
Secateurs
Hedge and branch shears
Wheelbarrow
Watering cans
Saws
Christmas tree stands
Christmas tree mats
Glitter
Top stars
Christmas baubles
The warranty applies to defects in materials or workmanship and not to defects caused by you.

DISCOUNTS AND PROMOTIONS
Discount codes cannot be combined and can only be used once per Customer. When ordering and in the order confirmation the Customer will be able to see what the discount code entails in price reduction per product and/or service. by Benson reserves the right not to accept discount codes when ordering.
Promotional campaigns are valid in accordance with the specific terms and conditions applicable to that particular promotion. by Benson reserves the right to withdraw such promotions at any time. Upon termination or withdrawal of a promotion, these Terms and Conditions shall apply without modification.
Offers on specific items on the Website are valid for a limited time and while stocks last.

CUSTOMER DATA
The Customer confirms that the personal data provided by the Customer in connection with the order are correct and completely filled in and is responsible for any incorrect data.
by Benson cares about your privacy and we want you to feel safe when you provide your information to us. by Benson is the data controller for the processing of the personal data provided by the Customer in connection with the order. Information on how by Benson processes the Customer's personal data can be found in by Benson's Privacy Policy.

OTHER
by Benson has the right to assign its rights and obligations under this Agreement, in whole or in part, to a third party on the same terms and conditions. The Client is only entitled to transfer his rights and obligations under the Agreement after written approval from by Benson.
All intellectual property rights and technical solutions relating to the products and services as well as the Website belong to by Benson or any third party with whom by Benson cooperates. by Benson and its partners retain all intellectual property rights to all information provided to the Client in connection with the Agreement and the Client's use of products, as well as to all other published material, trademarks, logos, images, videos, databases, etc. Such material as described in this paragraph may not be used by the Client without written permission from by Benson unless the Client's use is necessary for the Client to use the products and/or services under these Terms.
by Benson reserves the right to make any typing errors on the Website, including prices, as well as in descriptions in the form of images, videos, writing or other form, for any products ordered by the Customer through the Website, as well as any technical errors.
by Benson has the right to correct such possible errors and to change or update the information at any time without notifying the Customer. If an incorrect price has been quoted for a product or service ordered by the Customer, by Benson will notify the Customer by e-mail and await the Customer's approval of the corrected price or number until the Customer's order is to be delivered. In the event that approval is not received in time, by Benson has the right to remove the product or service from the Customer's order and credit the Customer for its value.

DISPUTE
These Terms are governed by Swedish law and all disputes shall be settled by a Swedish court.
Consumers also have the right to appeal to the Swedish Complaints Board (ARN). In the event of a dispute, By Benson will follow the recommendations of the ARN. You can read more about ARN at www.arn.se.
